1. Scope of application and contractor
1.1 The following General Terms and Conditions of Sale (hereinafter “GTC”) apply to orders of goods from the product range of the GamesCollections.ch Online Shop ( www.gamescollections.ch ) in the respective version valid at the time of the order.
1.2 The customer’s contractor is Easy4You Sagl, Via Giacomo Brentani 16, 6900 Lugano, Switzerland, e-mail: info@easy4you.cloud (hereinafter “Easy4You”).
1.3 The GTC form an integral part of the contract between Easy4You and the customer. Any deviating conditions of the customer are valid only if expressly accepted in writing by Easy4You.
1.4 The offer of items in the GamesCollections.ch Online Shop is addressed exclusively to persons and companies who have their residence or registered office in Switzerland or Liechtenstein and who can provide a delivery address in Switzerland or Liechtenstein.
2. Ordering procedure and contract conclusion
2.1 The customer can select items from the assortment and add them to the shopping cart by clicking on “add to shopping cart”.
2.2 By clicking “Order and pay”, the customer makes a binding offer to purchase the goods and accepts these GTC.
2.3 The automatic order confirmation by email confirms receipt of the order, but does not constitute acceptance of the offer.
2.4 The contract is deemed concluded with the declaration of acceptance by GamesCollections.ch, sent by email (order confirmation), or at the latest with the shipment or notification of collection of the goods.
2.5 In the event of unavailability of the ordered goods, GamesCollections.ch reserves the right to refuse the offer, informing the customer via email and refunding any payments already made.
2.6 If only part of the ordered goods are available or the quantities exceed those usual for domestic use, GamesCollections.ch may only partially accept the offer, informing the customer by email and refunding any payments relating to the unaccepted portion.
2.7 In the event of force majeure or causes beyond GamesCollections.ch's control that prevent partial or total shipment after the contract has been concluded, GamesCollections.ch may withdraw from the contract in whole or in part, informing the customer by email and refunding payments made for unshipped goods. Any further claims are excluded.
3. Deliveries
3.1 Shipments generally take place within 24/48 hours, unless otherwise specifically indicated on the product page.
3.2 GamesCollections.ch may make partial deliveries. The indicated delivery times are indicative and non-binding. In the event of delays, the customer may withdraw from the contract after providing at least 10 days' written notice; any payments will be refunded. Further claims are excluded.
3.3 The goods are delivered exclusively in Switzerland and Liechtenstein. Risk passes to the customer upon delivery to the carrier. The goods are insured by GamesCollections.ch against transport damage beyond the carrier's liability limit.
The customer must inspect the goods upon receipt and immediately report any visible damage to the carrier, reserving the right to make detailed written reservations. Non-visible damage must be reported to GamesCollections.ch within 5 days of arrival by email to info@gamescollections.ch . Failure to comply with these deadlines will result in the forfeiture of any right to make a complaint.
If there are difficulties accessing the delivery location, the customer must inform GamesCollections.ch in advance. The goods will be delivered to the closest, safely accessible location.
The customer is obligated to accept the shipment; otherwise, GamesCollections.ch may waive the fulfillment and seek compensation for damages. The right of voluntary return does not apply to rejected goods.
3.4 If the customer chooses to collect the goods, they will be notified by email when the goods are available. Risk passes to the customer upon receipt of the collection notice. To collect the goods, the collection notice and a valid ID must be presented.
The customer must collect the goods within 10 days of notification; otherwise, GamesCollections.ch may waive the obligation and seek compensation. The right of voluntary return does not apply in this case either.
4. Price and payment
4.1 Prices are expressed in Swiss francs (CHF) and include VAT, recycling fee and copyright.
4.2 Shipping costs and any other charges (e.g. payment surcharges) are indicated separately and charged additionally.
4.3 GamesCollections.ch reserves the right to verify the customer's creditworthiness and may share data with third parties for this purpose.
4.4 Payment of the price and expenses must be made immediately. Upon delivery or the expiration of the payment terms, the customer is in default without the need for a reminder.
Any debt collection costs are the responsibility of the customer. After a written extension of 10 days, GamesCollections.ch may suspend performance and seek damages.
Delivery costs for Switzerland and Liechtenstein: CHF 10.-
5. Retention of title
5.1 The goods remain the property of Easy4You until all purchase credits have been paid in full. The customer authorizes Easy4You to register this reservation in the relevant register at their expense.
6. Right of withdrawal and returns (RMA)
6.1 Although Swiss law does not provide a mandatory right of withdrawal for online purchases, GamesCollections.ch voluntarily offers a return service via the RMA (Return Merchandise Authorization) procedure .
The customer can request a return authorization within 10 days of receiving the goods by completing the appropriate RMA form available on the website.
6.2 Products must be returned intact, unused, and in their original packaging , complete with all accessories and manuals.
GamesCollections.ch reserves the right to refuse returns that do not meet these conditions.
6.3 Return shipping costs are the responsibility of the customer, unless otherwise indicated or in the event of an error attributable to GamesCollections.ch (e.g. incorrect or defective product upon delivery).
6.4 In case of acceptance of the return, the customer can choose between:
product replacement , if available;
issuing a purchase voucher of equal value;
partial or total refund , as agreed with customer service.
6.5 The customer's rights relating to defective or non-compliant products , governed by Article 7 (Warranty), remain unchanged.
7. Warranties and responsibilities
7.1 Easy4You guarantees that the delivered products comply with the contract and are free from defects.
7.2 The customer's legal rights for defective products are governed by Swiss law. The customer must report defects within a reasonable time.
7.3 Easy4You is not liable for indirect or consequential damages, except in cases of intent or gross negligence.
8. Data protection
8.1 GamesCollections.ch processes customer personal data in accordance with Swiss data protection law. For more information, please see our data processing page.
9. Miscellaneous
9.1 If any provision of the GTC is invalid, the remaining provisions shall remain valid.
9.2 Swiss law applies exclusively. The CISG is excluded.
9.3 For disputes with consumers, the competent court is the customer's domicile or that of Easy4You. For other disputes, the exclusive jurisdiction is the headquarters of Easy4You.
